Here they come again….

I rarely type anything up for the site, as I don’t contribute to the sites content, I only help maintain it;  however, since I have spent considerable time working on making it run properly for Taaj, I took particular interest when once again Web-sheriff sent Go-daddy complaints that the site violated the Estate–this time Trademarks… allegedly.  The Trademarks are the words “Michael Jackson”, and the words “The Official Online Team of Michael Jackson” (which was trademarked AFTER www.teammichaeljackson.com website was created).  I will call www.teammichaeljackson.com – TMJ for the rest of this blog to shorten up what is being discussed.

If you all remember, the TMJ site had already been sent complaints when the website was first noticed by the Estate – back in April of 2011.   In the past complaint, the Estate objected to the name of this website, AND they wanted Taaj to sign it over to them should the Arbitration forum find in their favor.   The facts/findings of Arbitration can be found here:  http://Triumph-International-Inc-v-TeamMichaelJackson

In that case, they complained of the very same things that they are now.  That the site violated the trademark words “Michael Jackson” and trademark words “The Official Online Team of Michael Jackson”.   They have even gone so far this time, as saying “somewhere” on the site, TMJ claims to be a part of their team.   Make NO bones about it, THIS SITE is NOT affiliated with the Estate.  Nor has Taaj or any of her friends ever said they were–quite the opposite.  This can be seen in many of the sites documents and blogs.  In the last arbitration,  they lost, because this is a fan site, sharing documents, and blogging about the various cases surrounding “anything” related to Michael Jackson.  It does not sell products, nor gain any profit.  But once again Taaj has to go through the rigmarole of being subject to their trying to take her website down, simply because they do not like the content.

In looking at the links that were submitted to her internet host, sent to them by Web-sheriff, received from the Estate… what I found was quite confusing at first.  Most of the links given objected to pages containing hyperlinks to court documents from the Katherine Jackson v AEG case.  PUBLIC court documents.  They have nothing to DO with this case, yet somehow they claim this violates their trademark.  They even listed the page containing a link to the Juror Redaction court documents from KJ v AEG.  Really?  HOW can the Juror Redaction court documents violate their trademark?   Other very odd alleged “trademark” infringements are to the page containing information about the Bush/Juliens auction.  Taaj actually has a letter from them in the past, stating they are in NO way connected to the auction or Juliens, or Michael Bush, so how is this page now infringing?  Yet another link was a page with three hyperlinks to autopsies (not even the actual autopsies!)  How can hyperlinks be considered a trademark violation?  There is also objection to the page where TMJ supports Damien Shields and friends, of A Truth Untold.  Since when is it a trademark violation to support a cause?  A cause that isn’t even TMJ’s?

This is now becoming ridiculous and you can see that they simply are trying to censure what is being written about, as none of these pages have anything to do with them….. ahhhh but there is another link or 2 mixed into the “cluster f” of links…  The big ones–and its believed the ENTIRE reason that this has come up. In this pending case, TMJ was actually named several times by the Estate lawyers in the courtroom, that Taaj shouldn’t be there, that the court documents needed to be sealed immediately because TMJ had a copy of them- and they were being published online, and so on and so forth.  What exactly is it that they are afraid the court docs will be able to show?  You can see for yourself by reading the first link.

In total they sent the host 108 (yes 108) links that they considered infringing on their trademarks.  You decide, click the links, do you see infringing trademarks?   It’s not against trademarks to write about Michael Jackson, nor to post public court documents surrounding cases that have to do with Jackson or the Estate, or his death.  Nor is it against trademark to discuss the Official Online Team of Michael Jackson.  Nor for that matter to discuss Web-sheriff.  Yes, BELIEVE IT OR NOT one of the links listed is a blog where Taaj talks about Web-sheriff harassing this site—AGAIN.  John (aka Web-sheriff),  how is Taaj now violating you too?  Copyrighting and stating your email is confidential and only intended for the party addressed (Taaj) means that if it ends up in the wrong hands (an unintended party), its considered confidential and cannot be forwarded or copied or sent to anyone.  It doesn’t mean that TAAJ has to keep it confidential!  I bet you get people to fall for that all the time.
